Who We Are

The Garden Route's integrated property compliance consultancy

Property Compliance Consult was founded to solve a real gap in the Garden Route and Western Cape market. Most firms offer town planning or compliance certificates — none combine those with protected tree permit facilitation under one roof.

We take your property from initial audit through to fully compliant — whether you need a rezoning, a transfer-ready COC package, a protected tree licence before site clearing, or all three at once.

Protected Tree & Environmental Permits

Don't remove a tree
without a licence

In the Garden Route and Western Cape, dozens of indigenous tree species are legally protected under the National Forests Act. Removing one without a DFFE licence is a criminal offence. We handle the full permit process.

National Forests Act 84/1998 — DFFE

Protected Tree Licences

Section 15 of the NFA prohibits cutting, damage, or removal of any DFFE-listed tree without a licence. Common protected species in George include Milkwood, Outeniqua Yellowwood, Cape Fig, White Stinkwood, Wild Peach, and Cape Holly.

  • On-site tree species identification
  • Full Section 15 licence application to DFFE
  • Photographic record & site plan preparation
Garden Route Municipality Environmental Services

Municipal Tree Removal Approvals

Trees on municipal land, road reserves, street verges, and public open space require a separate written approval from Garden Route Municipality Environmental Services — independent of any DFFE licence.

  • Formal written application to municipality
  • Motivation report preparation
  • Liaison with Environmental Services
NEMBA AIS Regulations 2016 — DFFE

Alien & Invasive Species Plans

Landowners are legally required to manage listed invasive species on their property. AIS compliance plans are increasingly a condition of subdivision, rezoning, and development approval in the George area.

  • AIS site assessment & species identification
  • AIS compliance plan preparation
  • Submission as development approval condition
Garden Route GIZS 2023 — Environmental Overlays

Significant Tree Assessments

Certain trees may be protected through title deed conditions, heritage overlays, or environmental management overlay zones in the Garden Route GIZS 2023. We audit all applicable protections before any site clearing begins.

  • Title deed condition review
  • GIZS overlay zone assessment
  • Significant tree report preparation
Non-compliance carries criminal consequences.

Cutting or removing a protected tree without a DFFE licence is a criminal offence under Section 15 of the National Forests Act 84 of 1998. Penalties include fines and rehabilitation orders. Never instruct a contractor to clear a site without a signed licence in hand. We ensure you're fully permitted before any work begins.

Land Use & Rezoning
Advisory

Every property in the Garden Route is subject to the applicable Integrated Zoning Scheme. If what you want to do falls outside your current zone — running a guesthouse, splitting an erf, adding a second dwelling, or operating a business from home — you need a formal land use application. We navigate every step from feasibility to Municipal Planning Tribunal approval.

Starting Point
01

Pre-Application Feasibility & Zoning Check

Before committing to any application cost, we assess your property's current zoning under the Garden Route GIZS 2023, check alignment with the GMSDF, and recommend the correct application route — saving you time and money upfront.

  • Current zoning verification under Garden Route GIZS 2023
  • Overlay zone check — environmental, heritage, floodplain
  • GMSDF spatial alignment assessment
  • Application route recommendation with cost indication
  • Written feasibility report within 24 hours
Consent Use Applications — Use Your Property Differently
Hospitality
02

Consent Use — Guesthouse / B&B

Operating a guesthouse or bed & breakfast from a residentially zoned property in the Garden Route requires a consent use approval from the Municipality. We manage the full application including public notification and MPT representation.

  • Consent use application under GIZS 2023
  • Site development plan preparation
  • Public participation & neighbour notification
  • Municipal Planning Tribunal representation
Home Business
03

Consent Use — Home Office / Business from Home

Running a professional practice, consultancy, or trade from your home in a residential zone requires formal consent use approval. Without it, you risk enforcement action and complications at transfer.

  • Business-from-home consent use application
  • Proof of ancillary use motivation
  • Compliance with GIZS home enterprise provisions
  • Full MPT submission and follow-up
Additional Dwelling
04

Consent Use — Second Dwelling / Granny Flat

Adding a second dwelling unit or granny flat to a Single Residential erf requires consent use approval under the GIZS. This applies even where the structure already exists — regularisation is possible through the consent use process.

  • Second dwelling consent use application
  • Coverage and bulk compliance assessment
  • As-built regularisation if structure already exists
  • Municipal Planning Tribunal submission
Departure Applications — Where Structures Deviate from Zoning
Building Lines
05

Departure — Building Line Relaxation

When a structure encroaches on a prescribed building line — front, side, or rear — a departure application is required. This is one of the most common compliance issues across the Garden Route, particularly with older properties and renovations.

  • Building line encroachment assessment
  • Departure application under GIZS 2023
  • Neighbour consent & public notice where required
  • Coordination with as-built plan submission
Coverage & Height
06

Departure — Coverage or Height Deviation

Structures that exceed the permitted site coverage percentage or maximum building height require a formal departure application. We assess the degree of deviation and prepare a motivated application to resolve the non-compliance.

  • Coverage and height deviation audit
  • Departure application preparation & submission
  • Motivation for exceptional circumstances
  • Integration with plan regularisation process
Unauthorised land use carries serious consequences.

Operating a business, guesthouse, or second dwelling without the required consent use approval is a contravention of the applicable Land Use Planning By-law. Garden Route Municipality actively enforces zoning contraventions and can issue compliance notices, cease-and-desist orders, and fines. Non-compliant properties also face complications at transfer — buyers' banks routinely flag zoning contraventions during bond assessment. We resolve these issues before they become crises.

Certificates of Compliance

Every COC certificate,
coordinated for transfer

Before any property transfers in South Africa, specific compliance certificates are legally required. We manage your full COC portfolio so nothing delays your transfer date.

Mandatory Nationally

Electrical COC (ECOC)

Confirms electrical installations comply with SANS 10142 and the OHS Act. Required for every property transfer — no exceptions. Must be less than two years old at date of transfer.

Valid 2 years from issue
Mandatory if Installed

Electric Fence COC

Separate from the ECOC — required for any electric fence installed after October 2012, or where changes to an existing system have been made. Issued by an approved installer.

Valid 2 years from issue
Mandatory if Gas Present

Gas Certificate of Conformity

Required for all fixed gas installations — stoves, geysers, built-in braais. High demand across the Garden Route due to load-shedding-driven gas conversions. Issued by LPGAS-registered installer.

Valid 5 years from issue
Banks & Conveyancers

Plumbing / Water Installation COC

Confirms water installation is compliant — no leaks, functioning meter, no stormwater entering sewer. Required by banks and conveyancers across the George area before transfer.

PIRB-registered plumber required
Coastal WC Standard

Beetle Clearance Certificate

Essential in Wilderness, Herold's Bay, Victoria Bay and across the Garden Route where wood-boring beetles are prevalent. Required by banks and buyers as a condition of sale in coastal areas.

SAPCA-registered inspector
Post-Build / Renovation

Occupancy Certificate

Required after new construction or significant renovation. Confirms the structure is plan-compliant and safe for occupation. Issued by Garden Route Municipality Building Control.
